This year the Governor signed a bill (HB 1586) loosening the school vaccine exemption process through the Department of State Health Services’ (DSHS) website. Without guardrails, this new policy puts students at risk – especially those who are immunocompromised and unable to get vaccinated.

The Texas Health and Human Services Commission (HHSC) is seeking public input on proposed rules for DSHS, the agency tasked with carrying out the intent of the law. Please take a few minutes to share your thoughts and remind HHSC about the unintended consequences associated with HB 1586.

Dear Executive Commissioner Young, As a concerned member of the public, I appreciate the opportunity to comment on the proposed rule: TAC, Title 25, Chapter 97 concerning Exemption from Required Immunization for School Enrollment. I strongly urge the Texas Health and Human Services Commission (HHSC) and the Department of State Health Services (DSHS) to weigh the impact of this proposed rule.

 

A downloadable immunization exemption affidavit can be easily replicated and widely distributed, increasing the number of non-medical exemptions from school required vaccines. Texas has just emerged from its worst measles outbreak in decades because of high immunization exemption rates. In addition, the state has seen a dramatic increase of 132,904 non-medical exemptions from one or more school vaccines during the 2024-2025 school year.

I respectfully request DSHS to require parents and individuals age 18 years and older to acknowledge viewing a clear and fact-based information web page about the risks of not vaccinating before they can download the exemption form. Thank you for your consideration.
